Shopping Guide

1. Validity:

All deliveries are subject exclusively to the following general terms and conditions of sale. Offers are subject to change. New price lists, on publication, supersede previous versions.

2. Delivery:

Delivery is free of charge above a net order value of EUR 240 (for pharmacies) and EUR 600 (for wholesalers). Cartage and delivery fees for postal shipments are payable by the recipient. Additional costs incurred by special delivery requests on the part of the customer are his/her responsibility. Orders to a value below the sums mentioned above are subject to a flat-rate postage & packaging charge. The choice of delivery route and method remains at the discretion of the supplier. The transport risk is borne by the customer.

Postage & packaging for shipments abroad are payable by the recipient.

3. Complaints:

Complaints can be considered only if reported within 14 days of receipt. A claim on the part of the buyer for rescission or compensation due to non-fulfilment is excluded. Goods may be returned only if previously agreed and if properly stored and handled, respectively.

4. Force majeure:

If delivery is rendered difficult or impossible due to acts of God, official acts, business closure, strike or similar circumstances – also affecting suppliers – the supplier shall be released from the duty to deliver for the duration of such impediment and its after-effects. Such events entitle the supplier to withdraw from the contract without liability for damages.

5. Prices:

The prices as valid on the day of delivery shall apply.

6. Payment:

Amounts are payable net, without deduction, within 14 days of invoicing.

In the event of arrears, the supplier is entitled to charge interest on arrears at 5% above the base rate of the German Bundesbank plus value added tax. Each reminder is subject to a fee of EUR 3.00 plus postage.

Only advance payment or direct debit are accepted from new customers, and for orders below EUR 110.

The customer may only offset in the case of counterclaims which have not been contested by the supplier or which have been legally established; the customer may exercise his right of retention only insofar as it is based on the same contractual relationship.

7. Retention of title:

The delivered goods remain the property of the seller until full settlement of all claims from the contractual agreement, and may not be encumbered with third-party rights. In the event of resale of the delivered goods, the buyer shall in advance assign any future receivables from the resale to the seller.

8. Court of jurisdiction and place of fulfilment:

The court of jurisdiction and place of fulfilment is 64347 Griesheim, Germany.
